Dispensaries

A medical marijuana dispensary is a facility registered by the Oregon Health Authority that is allowed to receive marijuana or immature marijuana plants and transfer that marijuana to a patient or a patient’s caregiver, if the patient or caregiver has an Oregon Medical Marijuana Program card.

Medical marijuana can only be dispensed to patients and caregivers who present a current and valid Oregon Medical Marijuana Program card and photo identification. No other sales or transfers are authorized.

Visiting a Dispensary

Minors are not allowed in a dispensary. A patient or the designated caregiver can visit, but without the physical card, neither will be able to purchase any medication in a dispensary.

Starting a Dispensary

To start a dispensary, a person must be a Person Responsible for the Facility (PRF), which means an individual of legal age, who owns or operates with legal responsibility for a facility, who meets the qualifications established in these rules, and who has been approved by the Authority. The initial process will require comprehensive merit-based application, including non-profit information, site locations, proof of capitalization, and other specific Dispensing Center or Cultivation Center business and operations plans.

  • A person convicted more than once for the manufacture or delivery of a controlled substance in Schedule I or Schedule II may not be responsible for a medical marijuana facility.
  • Must be located at least 1,000 feet from a school attended by minors or from another registered dispensary.
  • Laboratory testing is required for testing pesticides/mildew and THC/CBD content.
  • Must be in an enclosed, locked facility.
  • Must be located in an area that is zoned for commercial or industrial use or as agricultural land and may not be located at the same address as a marijuana grow site
  • Must have security equipment, such as surveillance cameras, on all secure and restricted access areas.

  • No. Minors under 18 are not allowed inside any part of a dispensary where marijuana is present, even if they are patients or employees.

  • Transfers of usable marijuana or immature plants will only be authorized by using the Medical Marijuana Transfer Authorization form. Only the patient, authorized caregiver or patient grower may be authorized to transfer usable marijuana or immature plants to the dispensary.

  • The Oregon Medical Marijuana Dispensary Program maintains a directory of licensed dispensaries on the web at http://www.oregon.gov/oha/mmj/Pages/directory.aspx.

    As of October 22nd, the Medical Marijuana Dispensary Program has approved 196 dispensary applications.

  • A dispensary is permitted to seek reimbursement for immature plants and medical marijuana products based on its normal and customary costs of doing business. A dispensary is required to document its costs of doing business and provide that information to the MMD on request. Please refer to Oregon Administrative Rule (OAR) 333-008-1210 for specifics.

  • All prepackaged usable marijuana products must be labeled with the following information:

    • The amount of THC and CBD in the usable marijuana product
    • If prepackaged, the weight or volume of usable marijuana in each unit, in metric units
    • The amount of usable marijuana in a finished product in metric units
    • Potency information
    • The laboratory that performed the testing
    • A warning label for edibles which states: “WARNING: MEDICINAL PRODUCT – KEEP OUT OF REACH OF CHILDREN” in bold capital letters, in a font size that is larger than the font size of the other printing on the label, such that it is easy to read and prominently displayed on the product

  • You will need to present your current valid Oregon Medical Marijuana Program card and photo identification.

  • No. You will not be able to visit a dispensary until your permanent card arrives in the mail. Generally, it takes between two and four weeks for the state to process your application and issue your card.

    You will however, be legal to:

    • Possess marijuana (24 oz)
    • Begin growing (18 plants under 1 foot, 6 plants over 1 foot)
    • Obtain marijuana from other patients (you can use networking sites such as Facebook or Craigslist to find other patients with extra medicine)

  • No. Onsite consumption of marijuana is prohibited by the Medical Marijuana Dispensary Program rules.

    The only exception is for an employee who is a current and valid Oregon Medical Marijuana Program patient who must medicate during working hours. Such consumption is only permitted if the employee is in a closed room, alone if the usable marijuana is being smoked, and not visible to the public, patients, or caregivers on the premises of the dispensary.
